Responsible for the protection of your personal data


HUAWEI TECHNOLOGIES DE MÉXICO, SA DE CV (hereinafter “Huawei”) with address located at Av. Santa Fe No. 440, 15th floor, Colonia Santa Fe, Delegation Cuajimalpa de Morelos, Postal Code 05348, Mexico, Federal District, is responsible for of the processing of your personal data (hereinafter, your "Personal Data").

Form and means of contact

Your Personal Data is collected and processed by Huawei or its managers, among others, for the following purposes:

1.  Provide services and products required by you.

2.  Inform about changes or new products and services related to what has been acquired or contracted by you or our clients.

3.  To comply with obligations to our customers.

4.  Evaluate the quality of our products and services.

5.  Request, buy, change, or return products, offered by Huawei, whether they are provided by Huawei or through third parties;

6.  Make payments online;

7.  Request invoices or digital tax receipts;

8.  Request a quote, information or free samples of products and services;

9.  Request the delivery, repair or warranty fulfillment of our products;

10.  Receive advertising in print or through electronic media, including communications for online marketing purposes, or telemarketing about our products and services;

11.  Create personal profiles;

12.  Participate in surveys;

13.  Use the different services of our website, including downloading content and formats;

14.  Notify Huawei about problems with your site;

15.  Participate in chats and/or online discussion forums about our products and services;

16.  Participate in trivia, contests, raffles, games and sweepstakes;

17.  Share your comments or suggestions about our products and services;

18.  Any other activity that is related to those described in the previously mentioned paragraphs.


In addition, Huawei, directly or through its managers, may use your Personal Data for the following purposes:

1.  Carry out studies on the demographic data, interests and behavior of its clients, consumers, suppliers, and those third parties with whom it deals;

2.  Carry out market and consumer studies in order to acquire and offer personalized products and services, as well as advertising and content more appropriate to the needs of its clients, consumers, suppliers and other third parties with whom it deals;

3.  Prepare internal statistics that indicate the services and products most appreciated by the different segments of its clients, consumers, suppliers and other users of the telecommunications services that the Responsible provides;

4.  Formalize the transactional process with your clients, consumers, suppliers and other third parties with whom you deal;

5.  Manage the process of requisition, evaluation and adjudication of suppliers and other third parties with whom it deals;

6.  If applicable, verify your credit and/or payment capacity, which may be done through credit information companies, in terms of the Law to regulate Credit Information Companies;

7.  Check business transactions made by you with Huawei;

8.  Keep a record of the operations and information reviewed in the different sections of the telecommunications services that Huawei provides and that it collects through automatic data capture tools;

9.  Send you notification of offers, notices and/or promotional messages, which will be sent to you, unless you expressly state your wish not to receive such offers. Occasionally such offers may contain information from Huawei vendors or other third parties.

10. Sharing your personal data with database administration and management service providers; automated processing of personal data and its storage; email authentication and validation; recruitment; audit services, and other services of a similar nature to those described.

Data collected and means of obtaining personal data

The Personal Data that we collect from you, for the purposes described in this Privacy Notice, are collected in different ways, among which are, but not limited to: when they are provided directly by you, through collection data when browsing Huawei web sites and pages, by using Huawei online services that are found in cookies, or web beacons, or, when the information is obtained through other sources permitted by Law, and links in emails.

Use of cookies and web beacons. Cookies are text files that are automatically downloaded and stored on the hard drive of the user's computer equipment when browsing a specific internet page, which allow the internet server to remember some information about the user, including their preferences for display of pages of a server, name and password.

For their part, web beacons are images inserted into a web page or email, which can be used to monitor the behavior of a visitor, such as storing information about the user's IP address, duration of interaction time on said page and the type of browser used, among others.

We inform you that when you access our website, information regarding your cookies and web beacons is received by us, the above to obtain information such as your type of browser and operating system, the Internet pages you have recently visited , the links you have recently followed, the IP address of your computer, the site you closed before entering our Internet portal, among others.

Sensitive personal data
We inform you that in order to comply with the purposes set forth in this Privacy Notice, sensitive personal data may be collected and processed, such as: sexual preference, physical condition, state of health, disability and medical documents, bank information, among others, to for which you will be asked for your express consent. We promise that they will be treated under the strictest security measures that guarantee their confidentiality.

Limitations on the use of personal data
You can limit the use of your Personal Data in order not to continue receiving information about the promotions and additional services that we offer by sending your request to the email address privacidadmx@huawei.com, or by writing to the following address: Av. Santa Fe No. 440, 15th floor, Colonia Santa Fe, Cuajimalpa Delegation, Postal Code 05348, Mexico, Federal District.

Process to access rectify, cancel or oppose the use of your personal data
To exercise the rights of access, rectification, cancellation and opposition (“ARCO Rights”), enshrined in the Federal Law on Protection of Personal Data Held by Private Parties, (hereinafter, the “Law”), you must present a request for access, rectification, cancellation or opposition with the following information and documentation:


1.  Name of the owner of personal data and address or other means to communicate the response to your request;

2.  The documents that prove your identity (simple copy in printed or electronic format of your voter identification card, passport or FM-3),

3.  The clear and precise description of the personal data with respect to which you seek to exercise any of the ARCO rights, and

4.  Any other element or document that facilitates the location of your personal data.

In the case of requests for rectification of your personal data, you must also indicate the modifications to be made and provide the documentation that supports your request.

For the reception, registration and attention of the requests to exercise your ARCO Right to your Personal Data, as well as to limit the use or disclosure of your Personal Data and the other rights provided in the corresponding law, please send an email to privacidadmx @huawei.com, or send a letter to the following address: Av. Santa Fe No. 440, 15th floor, Colonia Santa Fe, Cuajimalpa Delegation, Postal Code 05348, Mexico, Federal District.

Huawei will respond to you within twenty business days, counted from the date on which the request for access, rectification, cancellation or opposition was received, the decision adopted, so that, if appropriate, it becomes effective within fifteen days following the date on which the response is communicated. In the case of requests for access to Personal Data, Huawei or its managers will proceed with their delivery after proving the identity of the applicant or their legal representative, as appropriate. The aforementioned terms may be extended only in terms of the applicable legislation.

The delivery of your Personal Data will be free, so it will only correspond to you to cover the justified shipping costs or the cost of reproduction in copies or other formats. In the event that you reiterate your request in a period of less than twelve months, you must cover the corresponding costs equivalent to 3 days of the Minimum Wage in force in the Federal District in terms of the corresponding Law, unless there are substantial modifications to the Notice of Privacy that motivate new consultations.

For the purposes of requests for cancellation of Personal Data, in addition to the provisions of this Privacy Notice, the provisions of Article 26 of the Law will apply, including the exception cases of cancellation of personal data indicated therein.

Data transfer, national and international
Your personal data may be transferred and processed within and outside the United States of Mexico, by persons other than Huawei. Your personal data will not be transmitted to third parties without your consent, except for the exceptions provided for in article 37 of the Law, as well as the other exceptions included in said legal system.

Modifications to the privacy notice
Huawei Technologies de México, SA de CV reserves the right to periodically update this Privacy Notice to reflect changes in our information practices. It is your responsibility to periodically review the content of the Privacy Notice on the site http://www.huawei.com/mx/ Huawei, you will understand that if you do not express otherwise, it means that you have read, understood and agreed to the terms set forth therein, which constitutes your consent to the changes established in said updates regarding the treatment of your Personal Data for the purposes of the Law and other applicable legislation.

Links to third party websites
Huawei's Privacy Notice only concerns the website owned by us, so it does not include links to third-party websites. The use of information collected by these sites is entirely the responsibility of the third party websites. You should be aware that other organizations have their own privacy notices regarding the collection and use of personal information, as well as the use of cookies. We recommend that you read their privacy policy or contact the organization that owns the third party website.

Improper processing of your personal data
If you consider that your right to protection of personal data has been violated by any conduct of our employees or our actions or responses, or, you presume that in the processing of your personal data there is a violation of the provisions set forth in Federal Law Protection of Personal Data Held by Individuals, you can file the corresponding complaint or denunciation with the INAI, for more information visit www.inai.org.mx.

Consent
For the purposes of the provisions of the Law and in particular its Article 17, you declare (i) that this Privacy Notice has been made known to you by Huawei, (ii) you have read, understood and agreed to the terms set forth in this Privacy Notice, for which you grant your consent regarding the processing of your Personal Data for the purposes of the Law and other applicable legislation. In the event that the Personal Data collected includes sensitive or financial Personal Data, whether in printed format, or using electronic means and their corresponding processes for the formation of consent,

In the event that you do not oppose the terms of this Privacy Notice within the following 30 (thirty) days after it was made available to you, its content will be considered agreed and consented to, in terms of the third paragraph of article 8 of the Law. Your consent may be revoked at any time without retroactive effect.

Notwithstanding any provision of this Privacy Notice, you acknowledge that your consent will not be required for the processing of Personal Data by Huawei in any of the cases indicated in Article 10 of the Law. Any information related to our privacy
