Huawei Technologies Co. Ltd and its affiliates (collectively, "Huawei", "we", "us", and "our") respect your privacy. Please read the following Privacy Notice ("this Notice") to learn more.

This Notice applies to processing personal data collected in relation to Huawei’ websites, products, services, cooperation with our business partners and their employees, that display or provide links to this Notice.

This Notice describes how Huawei processes your personal data, based on Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”) and/or other laws and regulations related to personal data.

This Notice may not address all possible data processing scenarios. Huawei may inform you of product or service specific data collection through supplementary policies or notices, provided before collection.

Huawei reserves the right to update or change this Notice at any time. We will release the latest Privacy Notice on Huawei webpages. If major changes are made to the Privacy Notice, we may notify you through different channels, for example, posting a notice on our websites or sending you direct notification.

Please note that not all of those firms have their headquarters in European Union/EEA member countries or do not process personal data on the territory of the European Union/EEA, thus, the GDPR does not apply in all the cases.

1. How and What Personal Data We Collect from You?

Before using Huawei’s products or services, you may need to provide personal data. In some cases, you may choose not to disclose your personal data to Huawei. However, not providing Huawei with certain data may mean that we cannot provide you with certain products or services or respond to an issue that you have raised.

You directly provide us with some data when you use our websites, products, or services, or interact with us by, for example, creating a Huawei account or contacting us. We may also obtain data by recording how you interact with our websites, products, or services. For example, we may use technologies like cookies or receive use data from software running on your device. Examples of personal information that may be collected and that allows direct identification are: your name, contact information, email address, job title, professional expertise and other information linked to these identifiers. We may also collect certain personal information that does not identify you directly by your name, but may be used to identify the specific computer or device from which you accessed our website - depending on how you interact with Huawei, for example, the website you visit or the products and services that you use. We also collect the information you provide to us and the content of messages you send us, such as the query information you provide, or the questions or information you provide for customer service support.

If you are our Supplier’s, Collaboration partner´s or Customer’s contact person we have received your data directly from you or indirectly from your employer/entity you represent (usually just name, work e-mail, phone, company name and position) or from publicly available sources (webpages). More details about the data we process are in the next section and/or in a more specific privacy notice, if applicable.

We do not process your data for automatic decision-making, including profiling.

Minors

Our websites, products and services are primarily intended for adults. A minor under 16 years old (“Child)” must not create a Huawei account without the consent of a parent or guardian. If a Child's personal data is collected with prior parental consent, we will only use or disclose the data as permitted by law, with the explicit consent of the Child's parents or guardians, or when necessary for the protection of the Child. If we accidentally collect a Child's personal data without verified prior consent from the Child's parents, we will attempt to delete the data as soon as possible.

2. Purpose, Legal Basis and Retention of Your Personal Data

We may use your personal data for the purposes below. Please note that, according to the data protection legislation in different jurisdictions, some legal bases may be different.

Creating an account;

Our legitimate interest to provide and manage your account, provide services to you and optimize our website, products and services, ensuring the safety (including online) of speakers and participants, and in internal reporting, regularly improving procedures for similar events organized by Huawei in the future. Article 6(1)(f) GDPR

We process your personal data to fulfill a contract with you or take steps to enter a contract - Article 6(1)(b) GDPR.

With regard to events, also legitimate interest in ensuring the safety (including online) of speakers and participants, and in internal reporting, regularly improving procedures for similar events organized by Huawei in the future. Article 6(1)(f) GDPR

Huawei ID account data will be stored until you deregister your account, the service is canceled, your account is deleted or the contract otherwise terminated.

We may also process data for the validity period of the contract concluded with Huawei by your employer/entity you represent as well as for the period of limitation of contractual claims.

Fulfilling your transaction or service requests, including fulfilling orders; delivering, activating, or verifying products or services;

Organizing workshops, webinars and training and certification sessions (online and personal meetings) ;

Providing technical assistance and support related to Huawei products and services, help desk services, ensure service or network functionality and service continuity, provide maintenance for products and services, troubleshooting. In this case, your personal data may be provided to Huawei by its contractual partners or directly by you.

Processing based on Huawei’s legitimate interest to execute the obligations in a contract with a legal person (e.g.: a business partner, a company), by offering assistance related to products and services, which may contain personal data or be used by individuals whose data may be disclosed to Huawei, at the moment of the technical assistance/troubleshooting/maintenance. This purpose aims mostly at network data (e.g.: IP address, traffic), e-mail and phone no., but other types of personal data may be necessary, depending on the technical assistance - Article 6(1)(f) GDPR

Processing based on contract with you – the necessity to execute our obligation to offer you technical assistance/troubleshooting/maintenance for the Huawei products/service - Article 6(1)(b) GDPR

We will process your data strictly for the period necessary to ensure technical assistance/troubleshooting/maintenance, controlling and improving the performance and quality of products and services; ensuring the security of systems, products, and services; handling possible user queries or complaints and locating problems

Conduct marketing or market surveys, improve our products and services;

Our legitimate interest in informing you, as our customer or partner, about products, solutions, services and offers that may be of interest to you.

Your consent to receive commercial information if you are not yet our partner or customer and your data has been collected through the forms of our website or through our other forms.

This basis for data processing applies only to the processing of personal data for marketing purposes on the basis of the GDPR.

We will process your data whichever comes first, until you withdraw your consent for receiving this type of information via e-mail or you object to the use of your personal data for marketing purposes.

Inviting you to participate in Huawei activities (including promotional activities);

Satisfaction surveys. In this case, your personal data may be provided to Huawei by our contractual partners.

Huawei’s legitimate interest to gather information about your/your company’s level of satisfaction on our services/products/assistance, for providing better client service, communication, development of business relations. For this purpose, we will process you name, company, position, e-mail address, phone no. and data related to products/services and customer satisfaction - Article 6(1)(f) GDPR

We will retain your personal data for the time necessary to achieve the purpose of assessing the client satisfaction and duly estimating the necessary measures for improving our services.

Providing you with customized user experience and content;

Processing based on the legitimate interests of Huawei when we use your personal data to improve our products and services, execute and improve our loss prevention, online security, cybersecurity, data protection and anti-fraud programs. Legitimate interests include enabling us to more effectively manage and operate our business and provide our products and services; protecting the security of our businesses, systems, products, services, and customers; internal management; complying with internal policies and processes, including ensuring this by performing internal audits; and other legitimate interests described in this Notice - Article 6(1)(f) GDPR

 The time required to retain personal data to fulfill business purposes, including providing products and services; controlling and improving the performance and quality of products and services; ensuring the security of systems, products, and services; handling possible user queries or complaints and locating problems

Improving our products and services through internal audits, data analysis, and research;

Analyzing the efficiency of our business operations and evaluating market share;

Sending you important notices, such as installation of and updates to operating system or application;

Ensuring the security of our products, services and customers or users, executing and improving our loss prevention and anti-fraud programs;

Social Media:

We have public profiles on the social networks Facebook / LinkedIn/Twitter/Instagram/YouTube/TikTOK etc.

As such, we process the data of visitors to these public profiles (including comments, likes, online identifiers):

  • in order to enable them to be active on the profiles;
  • in order to run the profiles effectively, by presenting information to the users of the portals about the initiatives and other activities of the Huawei and in connection with the promotion of various types of events, services and products;
  • for statistical and analytical purposes;
  • eventually may be processed for the purpose of redressing and defending against claims

The legal basis for the processing of your personal data is our legitimate interest in consisting of promoting Huawei own brand and improving the quality of the services provided, if necessary, asserting and defending against claims

NOTE: The above information does not apply to the processing of personal data by service administrators (Meta Platforms/LinkedIn/Twitter/Google/TikTok etc.).

Your personal data will be processed until the basis for their processing exists, i.e.:

- in the case of processing your data for the purpose of answering you, considering a complaint - until the complaint is solved, as well as for the purposes of storing evidence in order to defend against possible claims – until the period of limitation of claims expires

- in the case of user activity analysis - until the user account is deregistered

- if the basis for processing is an obligation resulting from the provisions of law - for the period specified in the relevant provisions.


3. How We Disclose Personal Data?

Huawei shares your personal data with other partners, as described in this Notice, when services are provided by partners authorized by Huawei. For example, when you make an online purchase from Huawei, we must share your personal data with the logistics provider to arrange shipment or a partner to provide services. In order to achieve the necessary purposes of personal data processing, Huawei may share your personal data also with for example accounting and legal service providers and communication platform providers. In addition, as a global company, we may share personal data with Huawei affiliates and subsidiaries.

Huawei and our authorized partners (data processors) shall establish by contractual mechanisms, technical, physical, administrative and procedural safeguards, in accordance with the adopted requirements and standards, to ensure confidentiality, security, the integrity and availability of personal data processed and their protection against unauthorized use or unauthorized access to personal data, as well as to protect against breaches of data security and confidentiality.

In addition, as a global company, we may share personal data with entities that are part of our global structure. These entities can support Huawei's activities and provide us with support services, for example, data storage. Your personal data may be shared within the Huawei Group only for clearly defined and lawful purposes, in accordance with applicable laws. For more information on possible data transfers outside the EU/EEA territory, see section 7 below.

In order to comply with the applicable laws or in response to the applicable legal procedures, Huawei may be required to disclose personal data to law enforcement authorities or other government agencies in accordance with data protection rules and provided there is a legal basis for the disclosure. If Huawei is involved in a restructuring, merger & acquisition, or a bankruptcy or liquidation lawsuit in a given jurisdiction, your personal data may be disclosed in connection with the transaction. Huawei may also disclose your data when appropriate, for example, to execute Terms and Conditions, when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or when it is in connection with an investigation of suspected or actual illegal activity.

4. How to Access & Control Your Personal Data?

It is your responsibility to ensure that all personal data submitted to Huawei is correct. Huawei is dedicated to maintaining the accuracy and completeness of personal data and keeping the data up-to-date.

You have certain legal rights in relation to your personal data, which you can find described below. Depending on the case and the legal basis for processing your personal data, these rights may be subject to certain restrictions under the applicable data protection rules. We may decline the request if we have reasonable grounds to believe that the request is a fraudulent, unfeasible or may jeopardize the privacy of others.

As a data subject you have the following general rights related to the processing of personal data. Please note that not all of those rights apply in all cases, depending on the legal basis of processing and the case:

Right of access

You have the right to obtain confirmation from Huawei as to whether personal data concerning you is being processed and to receive a copy of your personal data and specific information about how Huawei processes your personal data.

Right of rectification (correction)

You have the right to request Huawei to correct inaccurate personal data concerning you and the right to complete incomplete personal data.

Right of erasure (deletion)

You have the right to request Huawei to delete your personal data

Right of restriction

You have the right to request that Huawei limit data processing (in situations specified in the provisions of the GDPR)

Right of objection

You have the right to object to the processing of your personal data.

Right of portability

You have the right to receive personal data in a structured, commonly used and readable format and to transfer this data to another administrator, if your personal data is processed on the basis of your voluntary consent, in order to perform the contract or is processed in an automated manner.

Right to withdraw your consent

Where the legal basis of processing Personal Data is based on consent, you have the right to withdraw your consent at any time by providing a withdrawal notice to Huawei. Please note, however, that the withdrawal of your consent will not affect any use of the Personal Data made before you withdrew your consent.

Right to lodge a complaint

If you consider your Personal Data is not being processed in compliance with the applicable laws, you have the right to lodge a complaint with any relevant supervisory authority. 5. How We Protect Your Personal Data?

The security of your personal data is important to us. We use appropriate physical, organization, and technical measures to protect your personal data from unauthorized access, disclosure, use, modification, damage, or loss. For example, we use cryptographic technologies for data confidentiality, protection mechanisms to prevent attacks, and access control mechanisms to permit only authorized access to your personal data. We also provide training on security and privacy protection for employees to raise their awareness of personal data protection. Huawei is committed to protecting your personal data; however, please note that no security measure is perfect.

6. Third-Party Providers and Their Services

During your navigation on Huawei websites, when interacting with Huawei, or when using our services or products, you may encounter content or web links from third parties other than Huawei and its partners ("third parties"). Please note that if you choose to use that content, products, services, click on links or provide your data to such third parties, Huawei does not have the right to control them, and takes no responsibility for them, as they are related to independent controllers.

Huawei cannot control the privacy practices and data protection policies of third parties that are not subject to this Notice. When you submit personal information to such a third party, please read and refer to the privacy protection policy of the third party.

7. International Transfers of Your Personal Data

As a global company, your personal data collected by Huawei may be processed or accessed in the country/region where you use our products and services or in other countries/regions where Huawei or its affiliates, subsidiaries, service providers or business partners have a presence including companies located in the People's Republic of China or other countries outside of the European Economic Area. These jurisdictions may have different data protection laws. In such circumstances, Huawei will take measures to ensure that data is processed as required by this Notice and applicable laws, which includes when transferring the data subject’s personal data from the EU to a country or region which has not yet been acknowledged by the EU Commission as having an adequate level of data protection, we may use a variety of legal mechanisms, such as signing standard contractual clauses approved by the EU Commission, obtaining the consent to the cross-border transfer of a data subject in the EU, or implementing security measures like anonymizing personal data before cross-border data transfer. 8. Glossary

Controller

A Controller is an organization who (alone or jointly with others) determines the purposes and means of the processing of personal data.

Data Transfer Agreement

An agreement containing standard data protection clauses adopted by the European Union Commission as referred to in Article 46(2)(c) of the GDPR.

Data Subject

The identified or identifiable natural person to whom the Personal Data relates.

GDPR

The European Union General Data Protection Regulation (2016/679).

Legal Basis

Processing of Personal Data is only lawful if and to the extent that at least one legal basis specified in the GDPR applies.  The available legal bases are summarized as:

  • consent of the data subject
  • processing necessary to enter into or perform a contract
  • necessary for compliance with a legal obligation
  • processing necessary in order to protect the vital interests of the Data Subject or another natural person
  • processing necessary for the purposes of the legitimate interests pursued by the Controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the Data Subject which require protection of Personal Data (Legitimate Interests).

Personal Data

Any information relating to an identified or identifiable natural person (Data Subject); and identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Process/Processing

Any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Special Category Personal Data

Personal Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.

Huawei reserves the right to update or change this Policy at any time. We will release the latest Privacy Notice on this page for any changes.
