This Notice applies to processing personal data collected in relation to Huawei’ websites, products, services, cooperation with our business partners and their employees, that display or provide links to this Notice.
This Notice describes how Huawei processes your personal data, based on Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”) and/or other laws and regulations related to personal data.
This Notice may not address all possible data processing scenarios. Huawei may inform you of product or service specific data collection through supplementary policies or notices, provided before collection. Huawei reserves the right to update or change this Notice at any time. We will release the latest Privacy Notice on Huawei webpages. If major changes are made to the Privacy Notice, we may notify you through different channels, for example, posting a notice on our websites or sending you direct notification. For ease of understanding of this Notice, you have a glossary at the end of this document.
Huawei Subsidiaries listed in below in this Statement and Huawei Technologies Duesseldorf GmbH (hereinafter individually as “Controller” and collectively as “Controllers”, “Huawei”, "we", "our" and "us") work together closely. This also concerns the processing of your personal data.
Under the provisions of GDPR, we are “joint controllers” of the processing of your personal data described in this Statement. This means that we all decide why and how your personal data is processed. It also means that we are jointly responsible to you for that processing (Art. 26 of GDPR).
Please note that not all of those firms have their headquarters in European Union/EEA member countries or do not process personal data on the territory of the European Union/EEA, thus, the GDPR does not apply in all the cases.

Before using Huawei’s products or services, you may need to provide personal data. In some cases, you may choose not to disclose your personal data to Huawei. However, not providing Huawei with certain data may mean that we cannot provide you with certain products or services or respond to an issue that you have raised.
You directly provide us with some data when you use our websites, products, or services, or interact with us by, for example, creating a Huawei account or contacting us. The personal data that we collect about you is detailed in the table below. Please note that we may involuntarily process additional data, even if we do not request it, if your messages to us contain any data that is not listed in this privacy notice.
If you are our Supplier’s, Collaboration partner´s or Customer’s contact person we have received your data directly from you or indirectly from your employer/entity you represent (usually just name, work e-mail, phone, company name and position) or from publicly available sources (webpages). More details about the data we process are in the next section and/or in a more specific privacy notice, if applicable.
We do not process your data for automatic decision-making, including profiling.
Our websites, products and services are primarily intended for adults. A minor under 16 years old (“Child)” must not create a Huawei account without the consent of a parent or guardian. If a Child's personal data is collected with prior parental consent, we will only use or disclose the data as permitted by law, with the explicit consent of the Child's parents or guardians, or when necessary for the protection of the Child. If we accidentally collect a Child's personal data without verified prior consent from the Child's parents, we will attempt to delete the data as soon as possible.
We use your personal data for the purposes below. Please note that, according to the data protection legislation in different jurisdictions, some legal bases may be different.

Huawei shares your personal data with other partners, as described in this Notice, when services are provided by partners authorized by Huawei. In order to achieve the necessary purposes of personal data processing, Huawei may share your personal data also with for example accounting and legal service providers and communication platform providers. In addition, as a global company, we may share personal data with Huawei affiliates and subsidiaries.
Huawei and our authorized partners (data processors) shall establish by contractual mechanisms, technical, physical, administrative and procedural safeguards, in accordance with the adopted requirements and standards, to ensure confidentiality, security, the integrity and availability of personal data processed and their protection against unauthorized use or unauthorized access to personal data, as well as to protect against breaches of data security and confidentiality.
In addition, as a global company, we may share personal data with entities that are part of our global structure. These entities can support Huawei's activities and provide us with support services, for example, data storage. Your personal data may be shared within the Huawei Group only for clearly defined and lawful purposes, in accordance with applicable laws. For more information on possible data transfers outside the EU/EEA territory, see section 7 below.
In order to comply with the applicable laws or in response to the applicable legal procedures, Huawei may be required to disclose personal data to law enforcement authorities or other government agencies in accordance with data protection rules and provided there is a legal basis for the disclosure. If Huawei is involved in a restructuring, merger & acquisition, or a bankruptcy or liquidation lawsuit in a given jurisdiction, your personal data may be disclosed in connection with the transaction. Huawei may also disclose your data when appropriate, for example, to execute Terms and Conditions, when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or when it is in connection with an investigation of suspected or actual illegal activity.
It is your responsibility to ensure that all personal data submitted to Huawei is correct. Huawei is dedicated to maintaining the accuracy and completeness of personal data and keeping the data up-to-date.
You have certain legal rights in relation to your personal data, which you can find described below. Depending on the case and the legal basis for processing your personal data, these rights may be subject to certain restrictions under the applicable data protection rules. We may decline the request if we have reasonable grounds to believe that the request is a fraudulent, unfeasible or may jeopardize the privacy of others.
As a data subject you have the following general rights related to the processing of personal data. Please note that not all of those rights apply in all cases, depending on the legal basis of processing and the case:

The security of your personal data is important to us. We use appropriate physical, organization, and technical measures to protect your personal data from unauthorized access, disclosure, use, modification, damage, or loss. For example, we use cryptographic technologies for data confidentiality, protection mechanisms to prevent attacks, and access control mechanisms to permit only authorized access to your personal data. We also provide training on security and privacy protection for employees to raise their awareness of personal data protection. Huawei is committed to protecting your personal data; however, please note that no security measure is perfect.
During your navigation on Huawei websites, when interacting with Huawei, or when using our services or products, you may encounter content or web links from third parties other than Huawei and its partners ("third parties"). Please note that if you choose to use that content, products, services, click on links or provide your data to such third parties, Huawei does not have the right to control them, and takes no responsibility for them, as they are related to independent controllers.
Huawei cannot control the privacy practices and data protection policies of third parties that are not subject to this Notice. When you submit personal information to such a third party, please read and refer to the privacy protection policy of the third party.
As a global company, your personal data collected by Huawei may be processed or accessed in the country/region where you use our products and services or in other countries/regions where Huawei or its affiliates, subsidiaries, service providers or business partners have a presence including companies located in the People's Republic of China or other countries outside of the European Economic Area. These jurisdictions may have different data protection laws. In such circumstances, Huawei will take measures to ensure that data is processed as required by this Notice and applicable laws, which includes when transferring the data subject’s personal data from the EU to a country or region which has not yet been acknowledged by the EU Commission as having an adequate level of data protection, we may use a variety of legal mechanisms, such as signing standard contractual clauses approved by the EU Commission, obtaining the consent to the cross-border transfer of a data subject in the EU, or implementing security measures like anonymizing personal data before cross-border data transfer.
